This Technical Report provides the basis for the recommendations found in the American Academy of Pediatrics Policy Statement, “Understanding Liability Risks and Protections for Pediatric Providers During Disasters.” Concepts discussed include those related to: altered health care environment and practice during a disaster; liability risks during a disaster; legislation providing protections from civil liability during a disaster; role of malpractice insurance; mitigating liability risks during a disaster; the bridge between liability concerns and patients’ rights; and oversight of pediatric medical response during disasters.
